Timeshare Only question
|
Question: A few years ago I got caught into timeshare scam overseas which I only lost
my deposit of AU$3000 I have this contract for three years which expire late
next year in this contract it said that the time share company would not
pursue anymore outstanding amounts. I have used the timeshare only twice. I
received a bill payment in US 195 dollars for management fees which I have
to pay within two weeks otherwise my membership is suspened and penalities
imposed. What are my legal obligations if I don't pay and cancel my
membership as the contract did say full and final payment from me. I would
appreciate helpful advice as I work in the airline industry and I do not
need anymore timeshare.
Answer: First of all, your opening comments are a lie, if the following
comments are true. If it was a "scam" you would have nothing to worry
about - you would have lost your 3 grand, and that is the end of it.
IF the first is a lie, then no "scam" has taken place, and you have a
valid time share agreement. It has, as is understood from your text,
less than a year to run on it. It is presumably a saleable commodity,
and when you pay the fees involved you sell the remaining time for
something less than 1000 (in proportion to the 3000 grand you paid)
Alternately tell them to stick the bill, and you forgo all rights to
the time share unit.
